Within copyright there are already provisions for transformative works and fair use. Copyright infringement involves taking exactly what someone else did in a non-transformative way, while it is still under protection, and claiming authorship or publishing rights over that work. How would it ever be ok to do that without permission of the works' creator? Creative Commons licensing is an option for people who choose to do that with their work, but it is not the default license. Platt screwed up if he signed away his rights, because Fox would be liable for all of that improper distribution of his copyrighted performance if he had not signed it away.
